WHY?
The opportunity for things to go askew at
community associations is exacerbated by a
number of factors including a volunteer
governance structure and a lack of willingness
and/or ability to obtain the necessary support.
Moreover, community associations operate as
both nonprofit corporations and hyper-local
governments. These recommendations
preserve the right of private action supported
by a robust dispute resolution framework.
Easily accessible remedies for members of
community associations are widely recognized
as almost non-existent. Homeowners are
frequently at a disadvantage when resolving
disputes with an association whose mandatory
assessment revenue and D&O insurance
provides for the expenses of litigation.
Internal dispute resolution and alternative
dispute resolution reduce court dockets and
trials, and offer more efficient, cost-effective
options than litigation.
